At Baby Babbler, we respect the intellectual property rights of others and expect our users to do the same. We have established the following DMCA Takedown Policy to address situations where infringing material may be hosted on our platform.
Notification of Infringement If you believe that your copyright-protected work has been posted on Baby Babbler without your permission, please notify us by submitting a written DMCA notice. The notice should contain the following:
- Identification of the Copyrighted Work: A description of the copyrighted work that you claim has been infringed.
- Identification of the Infringed Material: A description of where the material that you claim is infringing is located on the Baby Babbler platform.
- Contact Information: Your address, telephone number, and email address.
- Statement of Ownership: A statement by you, made under penalty of perjury, that you are the owner of an exclusive right that is allegedly infringed.
- Good Faith Belief: A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- Signature: Your physical or electronic signature.

Response to Notification Upon receipt of a valid DMCA notice, Baby Babbler will promptly remove or disable access to the allegedly infringing material and will notify the user who posted it.
Counter-Notification If you believe that your material was removed or disabled by mistake or misidentification, you may send us a written counter-notice containing the following:
- Your Physical or Electronic Signature.
- Identification of the Material: Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
- Statement Under Penalty of Perjury: A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your Contact Information: Your address, telephone number, and, if available, email address.
- Consent to Jurisdiction: A statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Baby Babbler may be found, and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.
Upon receipt of a valid counter-notice, Baby Babbler will promptly provide the person who provided the original DMCA notice with a copy of the counter-notice and inform that person that Baby Babbler will replace the removed material or cease disabling access to it in 10 business days. Baby Babbler will replace the removed material and cease disabling access to it not less than 10, nor more than 14 business days following receipt of the counter-notice unless Baby Babbler’s designated agent first receives notice from the person who submitted the original DMCA notice that they have filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material on Baby Babbler’s platform.
Repeat Infringer Policy In accordance with the DMCA and other applicable laws, Baby Babbler has adopted a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. Baby Babbler may also at its sole discretion limit access to the platform and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
